1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Engaij Inc, a Delaware C-Corporation ("Company," "we," "us," or "our"), concerning your access to and use of the ExamPrepd website located at examprepd.com and any related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

ExamPrepd provides educational content and practice materials designed to help students prepare for scholarship examinations, including but not limited to ACER Scholarship Tests. The Service includes practice questions, typing exercises, writing prompts, AI-powered feedback, and performance analytics.

3. Eligibility

The Service is intended for users who are at least 13 years of age. Users under 13 may only use the Service with verifiable parental consent and under parental supervision, in compliance with the Children's Online Privacy Protection Act (COPPA) and applicable Australian privacy laws.

4. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

Parents or guardians who create accounts for minors are responsible for their child's use of the Service and compliance with these Terms.

6. Intellectual Property

All content on the Service, including questions, exercises, text, graphics, logos, and software, is owned by Engaij Inc or its licensors and is protected by United States and international intellectual property laws. You may use the content solely for your personal, non-commercial educational purposes. Any unauthorized use may violate copyright, trademark, and other laws.

7. Subscriptions and Payments

Some features require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your chosen plan in U.S. dollars or local currency as displayed
• Automatic renewal unless cancelled before the billing period ends
• Provide accurate payment information

Refund Policy: You may request a refund within 14 days of purchase if you are not satisfied with the Service. Refunds are processed at our reasonable discretion. Contact [email protected] for refund requests.

8. Educational Disclaimer

The Service is designed to supplement scholarship exam preparation. We do not guarantee any specific results or outcomes. Success in examinations depends on many factors beyond our control. The content is provided for educational purposes and should be used alongside other study resources. ExamPrepd is not affiliated with, endorsed by, or associated with ACER or any examination body.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including our compliance with COPPA and Australian privacy laws.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENGAIJ INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Engaij Inc and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

13. Dispute Resolution and Arbitration

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.

Class Action Waiver: YOU AND ENGAIJ INC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exception for Australian Users: If you are located in Australia, this arbitration provision does not limit any rights you may have under the Australian Consumer Law or to bring proceedings in an Australian court.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitations of liability, and dispute resolution provisions.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page, updating the "Last updated" date, and where appropriate, sending you an email notification. Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For users located in Australia, nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
